Sale of Services
These Terms and Conditions govern the sale of services available on our Site.
The following services are available on our Site:

Outdoor Christmas Lights Installation and Removal; and

Outdoor Christmas Lights Storage After Removal.
The services will be paid for in full payment is due upon completion of the service. However, a deposit may be required for custom projects or special-order materials before the service begins.
These Terms and Conditions apply to all the services that are displayed on our Site at the time you access it. All information, descriptions, or images that we provide about our services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all services we provide. You agree to purchase services from our Site at your own risk.
We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

Our Site may offer goods and services from third parties. We cannot guarantee the quality or accuracy of goods and services made available by third parties on our Site.

Refunds
Refunds for Services
We provide refunds for services sold on our Site as follows:

Deposits paid for special-order materials are non-refundable.
For a confirmed service installation, we require at least 48 hours' notice for cancellation. Cancellations made with less than 48 hours' notice are subject to a $100 cancellation fee.
Once the installation service is completed, all payments are final and non-refundable. We will, however, promptly fix any installation issues as part of our service guarantee.
Guarantees
The following guarantees apply to our Site:

Our "Season-Long Guarantee": We will repair any installation or material failures (excluding severe storms, physical damage, or tampering) for free, all season long (until Jan 15th).; and

Client Responsibilities: You must provide a safe, clear work area and access to a functioning, weatherproof power outlet (GFI) on the scheduled service date..

Consumer Protection Law
Where the Consumer Protection Act, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.
Links to Other Websites
Our Site contains links to third party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third party website or service linked to on our Site. It is your responsibility to read the terms and conditions and privacy policies of these third party websites before using these sites.
Limitation of Liability
Shalkovich Vladislav and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

Dispute Resolution
Subject to any exceptions specified in these Terms and Conditions, if you and Shalkovich Vladislav are unable to resolve any dispute through informal discussion, then you and Shalkovich Vladislav agree to submit the issue before a mediator. The decision of the mediator will not be binding. Any mediator must be a neutral party acceptable to both you and Shalkovich Vladislav. The costs of any mediation will be shared equally between you and Shalkovich Vladislav.
Notwithstanding any other provision in these Terms and Conditions, you and Shalkovich Vladislav agree that you both retain the right to bring an action in small claims court and to bring an action for injunctive relief or intellectual property infringement.

Insurance (WCB & CGL): We are fully insured with Commercial General Liability (CGL) coverage to protect your property and full WCB coverage for our team. This protects you from all liability.;

Season-Long" Service Guarantee: We guarantee our installation and materials for the entire holiday (until Jan 15th). We will repair any failures from normal wear (excluding storms or physical damage) for free.;

Client Responsibilities: You agree to provide a safe, clear work area (free of snow/ice) and access to a functioning, weatherproof power outlet (GFI) on the scheduled service date.;

Free Estimates: Booking an estimate on our site is a free, no-obligation consultation. The final quote provided after this consultation is valid for 14 days.;

Liability for Stored Goods: If you use our optional Takedown & Storage service, you agree that NorthFairytale is not liable for any damage, loss, or theft of your property during the storage period. This service is used at your own risk.; and

Photography Release: We will always ask for your written permission before taking "before and after" photos of your home for our website portfolio and social media..
Severability
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.
Changes
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.

As part of our all-in-one service, we offer to take down and store client-owned property (e.g., Christmas lights) for the off-season. While NorthFairytale will exercise reasonable care in handling and storing this property, you (the client) agree that NorthFairytale is not liable for any damage, loss, theft, or degradation of your property that may occur during the removal, transportation, or storage process. This storage service is used at your own risk.
Free Estimates & Consultations
We offer a complimentary, no-obligation on-site estimate (or "quote") for our services. This initial consultation is free of charge. The quote provided to you after this consultation is an estimate based on the visible scope of work and is valid for 14 days. Booking a free estimate on our website does not constitute a final contract for service installation.
Media & Photography Release
We are proud of our work and rely on "before and after" photos to show new clients what we can do. As part of our final service contract, we will ask for your written consent to photograph the completed installation. These images will be used strictly for promotional purposes, including our website portfolio and social media. We will never use or post images of your home without your explicit, signed permission.
Insurance & Liability (WCB & CGL)
NorthFairytale is fully insured for your peace of mind. We maintain active Commercial General Liability (CGL) Insurance to protect your property (including roofs, gutters, and siding) against any accidental damage during installation or removal.
Furthermore, we maintain full Workers' Compensation Board (WCB) Coverage for our team. This protects you, the homeowner, from any liability in the unlikely event of a worker injury on your property. We can provide proof of insurance upon request.
Service & Maintenance Guarantee
Our professional-grade lights and hardware are built to last. If any lights, timers, or clips that we installed fail due to normal seasonal wear (excluding physical damage, severe storms, wind, or homeowner tampering) anytime before January 15th, we will return to repair or replace the faulty items free of charge.
This is our "season-long" promise to you. We handle everything, so you can just enjoy the magic.
Client Responsibilities
To ensure your installation is completed efficiently, the client agrees to provide the following:
1. A safe and clear pathway to the installation area (e.g., clear of excessive snow, ice, or personal belongings).
2. Access to a functioning, weatherproof outdoor power outlet (GFI). NorthFairytale is not responsible for non-functioning outlets or electrical issues related to the client's home.
3. Access to the property on the scheduled installation date. A cancellation fee [inspired by user's request] may apply if we are unable to access the property upon arrival.
Modifications
This Privacy Policy may be amended from time to time in order to maintain compliance with the law and to reflect any changes to our data collection process. When we amend this Privacy Policy we will update the "Effective Date" at the top of this Privacy Policy. We recommend that our users periodically review our Privacy Policy to ensure that they are notified of any updates. If necessary, we may notify users by email of changes to this Privacy Policy.
